Local Law Firm Educates Business Owners and Human Resource Professionals about Transgender Inclusion in the Workplace

Skoler, Abbott & Presser, P.C., the leading labor and employment law firm serving the greater Springfield area, today announced Partner Marylou V. Fabbo and Attorney David W. McBride will present a breakfast briefing titled “Transgender Inclusion in the Workplace,” that will take place on Thursday, May 29, 2014. Though the topic is relevant nationwide, Massachusetts is one of only 16 states (plus the District of Columbia) with transgender explicit non-discrimination laws. Massachusetts is leading the way for transgender inclusion in the workplace and western Massachusetts specifically has a history of raising awareness for LGBT issues. For example, this past April, the city of Northampton hosted the 33rd annual LGBT parade and pride event.

Since the Massachusetts Transgender Equal Rights Act took effect in 2012, Massachusetts employees have been protected from discrimination based on gender identity and expression. However, legal protections afforded to transgender employees are not limited to those found within Massachusetts law.

“Employers should be aware of all laws that could impact the transgender employee – and the employee who is in transition – to avoid the risk of inadvertently engaging in illegal action,” said Attorney Fabbo. “Employers should implement policies and a procedure regarding transgender inclusion before an issue develops.”

Breakfast briefing discussion topics include:

  • Laws applicable to the transgender or transitioning employee
  • Restroom access, dress codes, appearance standards and name changes
  • Recommended policies and practices
  • Transition guidelines
  • What to avoid

The event costs $25, is open to the public and recommended for business owners and human resource professionals. Marylou Fabbo, a Ludlow resident and partner in the Springfield office, joined Skoler, Abbott and Presser in 1995. As head of the firm’s litigation team, Attorney Fabbo practices in all areas of employment litigation. She provides counsel to management on taking proactive steps to reduce the risk of legal liability that may be imposed as the result of illegal employment practices, and defends employers who are faced with lawsuits and administrative charges filed by current and former employers. She is a frequent speaker on employment-related topics and conducts extensive management training. Additionally, Attorney Fabbo is a published author, an active participant in the community and has repeatedly been recognized as a Super Lawyer by Boston Magazine.

David McBride, of Wilbraham, is a 2013 graduate from the Cornell Law School and received his Bachelor of Arts in economics from the University of Notre Dame in 2008. His practice is concentrated in labor law and employment litigation. Previously, Attorney McBride gained experience at a major labor union located in New York where he worked on labor and employment law issues including employer compliance with federal laws as well as assisting in preparation for litigation and arbitration
